Section 1:
Memberships:
1. New members must make sure you confirm your email address.
If you don't see the confirmation email,
check your junk or spam folder in your email that you signed up with.
* Keep in mind, if you don't confirm your email, you might not have access
to the site & you won't get email broadcasts on updates to the Community. Nor will you know if anyone's sent you messages.
** Failure to confirm your email will result in you being unable
to take advantage of the whole network.
2. Please use an original name & please no fake celebrity member profiles.
This should be self-explanatory, however, there are some people
who like to create fake profiles & dupe others
into believing that they're talking to
Ville Valo (for example) for whatever reason.
You may not register with the real names or aliases
(assumed or otherwise) of celebrities, eg. Ville Valo, etc.
Thank you
Anyone caught using a celebrity's name on here or being dishonest
about who they are will be deleted from the community & promptly reported
to higher powers, if needed.
Furthermore, if any members who have problems or encounter a member 'posing'
as someone else (celebrities or other) please contact the administrators here to let us know, ASAP.
Section 2:
Privacy Policy
3. To keep our members safe, per our Privacy Policy,
any administrators who host contests will NOT share any personal information
with anyone within or outside the community.
Furthermore, any members who share information of distribution of physical prizes
only share that information with the administrator hosting the contest.
It is NOT a requirement for members to share such information,
though winning would become null & void & prize would be offered to next runner-up.
Members are prohibited to disclose any information of a personal nature to others per the Privacy Policy.
* Violators of the Privacy Policy will be promptly removed.
4. Please do not give out personally identifiable information for your own safety.
For the most part, I don't think any of us are psychos,
but there are people outside our network who are
& I'd hate for them to see information that's posted-
you don't want some random stalker or murderer showing up at your door.
5. Respect the privacy of the members on this site,
as well as their personal families & friends.
Also speculation about a member's health, etc. is NOT to be discussed.
That is their business, not ours.
It's unfair to speculate & pass judgment on someone,
regardless of who they are, so please keep your speculations to yourself.

* Also, be careful when posting rumors.
Rumors of a defamatory nature will be removed without warning.
6. Please be respectful of fellow members.
Fighting and personal insults toward members here will not be tolerated.
We do not tolerate racism, sexism, abuse, victimization,
or any other types of discrimination.
We understand people have different opinions and debates
are more than welcome, as long as you only debate the idea
& not attack the person.
Also, general bitchiness/ cattiness toward anyone will not be tolerated.
It is expected that you show each other respect, even on other sites.
Members who spread rumours & lies about others-
even on other sites- will be removed from here for indulging in such behavior.
If you do have a problem with another member,
please be mature & discuss the problem with them in private messages.
But, above all, BE RESPECTFUL!
If the problem isn't resolved, please contact Magik about the problem.
Messages or other actions will then be taken to resolve the problem.

(since in the past, I had a member who did this on another site):
Do NOT ever post comments within the network here 'poking fun of'
or making rude comments about a person & referring to them as an echo, etc.
Act mature- consider the fact that we have members from different parts of this world
& not everyone is going to be completely fluent in English.
Keep in mind that it might be difficult for some to communicate the way they'd like to,
so they may repeat a little bit of what they read when they post something.
If that happens either pull up your big girl (or boy) panties and DEAL with it or leave.
This kind of rudeness will not be tolerated & I will NOT be pulled in 2 directions over this issue.
'Nuff said.
* Also, do NOT post any rumours of any members within the network here.
Rumors of a defamatory nature will be removed
& your account will be restricted for partaking in this behavior.
** Anyone who is cyber-bullying another member here will be removed & banned.
Bottom Line.
Section 3:
FANFICTION/ SLASHFIC/ PORN
We do not allow abusive, violent or overly pornographic material to be posted.
7. Obscene or pornographic pictures are not allowed.
Please remember that some of our fellow members may be young.
Any person that posts porn will have their account locked
or be removed from the network here.
Likewise, the post will be removed.
Use some common sense, please.
If it is an artistic tube used in a tag, that is one thing,
but I think we all should know what is considered porn & what is art.
Section 4:
Site Solicitation
8. Please don't join the site just to advertise for another site, shop, etc. & then leave.
Members who sign up only to advertise/ solicit their own site
(either here in the forum or elsewhere in general)
& are NOT active/ don't participate will have their account removed
within 30 days of the creation of their account.
Also, if I find out you are sending messages to members here to join your site,
you will be deactivated or removed.
I don't solicit my site on your community or site, so please don't do it here.

Section 5:
Applying for Administration
9. Members who wish to apply for administration,
must be a member for at least 2 months before you can apply.
Furthermore, if you apply to be a moderator, you need to be active-
meaning checking into the site more than once a week & interacting within the network/ with other members.
*Members who are currently Moderators/ Administrators will not lose their positions,
except under the following:
- One of the Terms of Membership or Privacy Policy is breached.
- They are not active in helping with the site, doing their duties
(basically only wanting the 'title' of admin.)
In other words, If you're not helping with the site, etc., esp. if I am busy/ gone
or unable to be on here right away.
- They choose to no longer be a moderator/ admin.
-Their account is inactive over a month.
Section 6:
Piracy/ Theft
10. Do not steal or hot-link our content.
Likewise, do not steal or hot-link another's content to post here.
If you choose to post/ share any images here in comments,
on your profiles or elsewhere, please upload them to your own server.
This also means that what is posted on MBM,
STAYS on MBM ONLY:
-Do not be copying my ideas,
using my badges, etc. for this forum
as templates for another site/ forum, etc.
Also, challenges (tasks), awards
or award concepts should NOT be copied
& used elsewhere.
I work very hard to create the challenges,
awards, badges, etc. for you.
It is RUDE to steal them & use elsewhere.
- Do NOT be posting download links
to kits I post for members here.
Those links are for MEMBERS ONLY
and are NOT to be shared outside this forum.
If there are freebie kits, etc. you'd like to share,
share the link to the blog (blog post is OK), designer's site only.

11. Sharing of links, files or zips to kits,
artist Tubes or Commercial Use items
(from any designer or artist) will NOT be tolerated!
It is illegal to post, trade or ask for kits, tubes or CU items
on this network that belong to other designers or artists
& it is also a breach of copyright law.
We are not a trading network, never have been, never will be.
Please buy the kits, tubes or CU items legally & support the artists & designers you love.
If you see something posted regarding links to illegal downloads please report them to Magik ASAP.
Same goes for any mail that is sent to you from another member with downloads.

(messages, groups, etc.) will have their account deleted

Section 7:
Tags & Other Image Linking
When using tags of any sort that is made for this site
& made available for members to use, it is preferred that members save the image
& upload that image & link from their own photo-hosting account (as mentioned above).
Images & other graphics for profile themes, etc. are hosted on 'my' photo hosting accounts
& too many members hotlinking these images can cause bandwidth overload to my accounts,
thus buggering up the whole site.
Section 8:
Photo Uploading Linking
12. At this time, it is forbidden to upload an image on this site
& then link it in a post/ comment/ reply.
Doing this steal's the site's transfer (bandwidth)
& too many people doing this will cause the site to be deactivated.
Please be proactive about helping me keep this network going for yours
& others' enjoyment- use your own photo hosting account.

* Hot-linking from another's photo hosting or other webhosting site
to post an image here in comments or on your own profile is NOT acceptable.
Section 9:
Plagiarism/ Content Theft
13. Please do NOT plagiarize from this site in any way.
What is posted on this site, stays on this site, unless otherwise stated.
To copy the hard work made by me (Magik) for the FAQ,
Terms of Membership, etc. or posts by the other members-
regardless of what it is- is plagiarism.
If you have a community or site, please be original
& don't steal another's hard work without permission.
If there is something posted by the Admin.,
or another member you'd like to use, please ask permission first
by the 'author' of the content.
If permission is given, please be respectful & give credit where credit is due...

Section 10:
Graphics- Tags & Other Images/ Usage
Tags or any other graphics, comment tags, etc., can be used
as they were intended ONLY.
You may use them when commenting & even using them to 'advertise' the site
on your own myspace accounts, etc.
(upload to your own photo hosting account first).
-Do NOT use the images to make a 'new' graphic (wallpaper, etc.)-
in whole or in part-
& then claim that work as your own.
That is ripping & is illegal.
- Do NOT remove credits or watermarks on these images & claim as your own.
Countless hrs. have gone into the work to make these for you.
All I ask is a little respect & common courtesy.

- Do NOT add names, brushes, etc. to any of the tags, centerpieces, etc.
you obtain from this site & claim them as yours.
- Do NOT rip any graphics or portions of any graphics to make into any other type of graphic.
- Do NOT rip apart any of my kits- either FTU or PTU and use to make your own kits for sale or free.
Any member doing this WILL be removed & banned.
I will report you to other designers, etc., also.
*If I see graphics made as described above (in whole or in part),
I will no longer make these graphics available for anyone to use.
Section 11:
Graphics- Site Themes
Graphics made for site themes may NOT be used elsewhere on the internet.
- Do NOT use these graphics to make a 'new' graphic & claim as your own.
As stated for tags & other graphics- this is also not allowed.
14. Any photos or artwork that do not belong to you
(not taken/ made by you) need to be tagged to credit the rightful owners.
I decided to add this into the rules because there are some communities
(that shall remain unmentioned, but are HIM communities)
where the members have either posted pictures/ artwork without credit
as well as those members posting photos without permission
(when the site or photographers have stated not to repost them elsewhere).
I simply don't want our site to be like those other communities.
I can be held liable as well.
15. If you post photographs or any other work by another person -
you must credit duly where deserved and- if possible-
place a link to official websites where you obtained the content.
If you post or upload a picture that you don't know who to credit, that is fine.
If one of the other members do know who the credit goes to,
they can let the poster know & the post then be edited.
* Keep in mind, posting someone else's artwork here
without permission/ credit is also prohibited.
Drawings, etc. that are not your own will NOT be approved
unless they are tagged with proper credit to the owners.
Section 12:
Prizes & Contests (Currently Not Applicable):
16. Contests may be held from time to time,
allowing members to win physical prizes.
If such contests are held, either by the site owner or any of the staff,
we may ask winners for mailing addresses to send out prizes.
Per our Privacy Policy, this information will NOT be shared with anyone
& the information will be destroyed after shipment of prize(s).
Winners have the right to withhold any information of their address,
but in so doing, relinquish those winnings to the next runner-up.
Eligibility:
Any member has the ability to enter contests.
Some contests may be only for 'active' members.
Active members can enter contests but anyone under the age of 18 MUST have parental consent.
Only members who have won the previous contest would be ineligible to enter the next contest.
This is to allow others a chance to win.
Prizes:
Prizes that are won are paid for either by the site owner
or any of the staff hosting the contests.
* Winners agree to NOT resell any prizes won for profit.
If any prizes are found on ebay or any other seller's site, etc.,
the member will no longer be eligible to enter contests &/ or
contests on this community will cease.
** Winners are NOT allowed to use prizes for contests,
competitions or giveaways on their own sites.
If I find that prizes from here are used elsewhere for competitions,
contests or any kind of 'giveaway', that member will be banned from this site.

Section 13:
Chat Box
We love to see you all post in the chat box.
Sharing thoughts, etc., as well as well-wishes for fellow members is acceptable & encouraged.
I will even allow comments about you posting being gone for an extended period of time,
provided you also post in the MIA boards, please.
17. If posting a comment that you're going to be gone,
it is not necessary to be specific.
Simply state 'for personal' reasons, school, work- that is acceptable.
Going into detail about a hospital stay, etc. is something better left in your MIA thread
or even in a private message to me where it's NOT public.
Section13A:
Moderation of Chatbox
Any moderators or administrators that are able to remove others' comments
from the chatbox have permission to remove them.
I only ask to remove anything that may be 'unacceptable'.
Send a message to the member who posted the comment explaining why it was removed.
If needed, link them back to the Terms of Membership.
Section 14:
Terms Of Membership Disclaimer
18. The Terms of Membership may be altered,
changed or added to at any given time.
Depending on any any issues that may arise,
the administrators & moderators of this network will discuss rules
or actions that may be needed or added.
However, in so doing, I, Magik, as owner of this network,
agree to send out an announcement & this Terms of Membership
will be modified as needed.
* Changes will take effect immediately
& a notice will be posted.
19. Any posts or other activity by members
that are in violation of any of these terms
will have their account deleted &/ or banned.
By registering with Forumotion & this site,
you agree to Forumotion's Terms of Use,
as well as the above Terms of Membership
and understand that membership can be withdrawn
if either agreement is violated.
If the certain behavior persists your account will be terminated
at the Network Creator's discretion.
20. The Manipulated By Magic site retains the right to remove content/
withdraw membership at our discretion without prior warning.
